Terms and Conditions

All bookings are accepted on the STRICT understanding that the learner or person booking a course has read, understood and accepted our terms and conditions.

Throughout the terms and condition, we will be referring to the following terms:

  • “You” or “Yours” refers to the learner – the person named on the booking form and the person who is booking the intensive course, the Pass Plus Course, the practical driving test or the theory test.
  • “ADI” or “Instructor” means the self-employed Approved Driving Instructor – who is fully vetted and registered by government agency, ADI’s are self-employed and thus are independent from us.
  • “We” “Us”, “booking agent” or “DriveEpic”- refers to DriveEpic Ltd – a booking and matching agent. We manage the delivery of intensive driving and Pass Plus courses, as well as booking and finding earlier dates for driving tests.
  • “Course” or “lessons” refers to the Intensive driving course you have booked and/or purchased.
  • “Test” refers to the practical driving test or the theory test. Both tests are managed by the DVSA.
  • “DVSA” refers to the Driver and Vehicle Standards Agency. We are not associated or affiliated with the DVSA, DVLA or any government agencies.
  • “Working days” only refers to days other than a Saturday, Sunday or public holiday.
  • “Successful booking” is when we match a learner with an Instructor and a course start date is agreed upon by both parties.
  • ”Force Majeure” – means an event or a sequence of events which DriveEpic have no influence or control over and therefore prevent or delay DriveEpic from providing the service under this agreement. These events can include and are not limited to; acts of God, war, riot, civil commotion, terrorist attacks, compliance with any law or government order (e.g. local and national), a fire, a pandemic of any disease, etc.

Courses

  1. Before driving lessons can commence all learners must be at least 17 years old and hold a valid Provisional Driving Licence. The learners must also be able to read (with glasses or contact lenses, if necessary) a car number plate made after 1 September 2001 from 20 metres. 
  2. Learners that fail to meet the standard sight test for driving will lose any hours they have pre-booked with the ADI. Refunds will be discussed at the instructor’s discretion in the case of a lesson/ course being cancelled due to the failure to meet the standard sight test criteria.
  3. You can purchase intensive driving courses from 5 hours to 45 hours. Once selected you are committed to the full number of hours that you have purchased.
  4. 5 to 20 hours courses should be taken over a consecutive 1 to 2 weeks period. 25 to 40 hours courses should be taken over a consecutive 1 to 3 weeks period. Therefore, you must have reasonable availability for lessons based on course you have selected.
  5. All arrangements for the driving lessons, including the start time and meeting location, shall be agreed upon between you and the instructor directly.
  6. Each course is for the total sum of hours booked. Your total course hours include the time to hire the car for the practical test, time for the practical test and to receive feedback from the DVSA examiner. As well as time to commute to and from your home or pre-agreed meeting point. Extra hours if required can be arranged directly with the instructor.
    1. For courses less than 5 hours, up to 3 hours are allocated to the test day.
    2.  For courses 10 hours or more, up to 4 hours are allocated to the test day.
    3. The hours allocated include 1 hour lesson, the car hire for the practical test, time for the practical test and to receive feedback from the DVSA examiner. As well as time to commute to and from the test centre.
  7. Your total course hours also include breaks i.e. bathroom breaks or/and meal breaks. Breaks length and rota should be agreed upon between you and the instructor directly.
  8. Course recommendations are based on average learning abilities and are advisory only. We cannot, and do not offer guarantees and you may need additional training or lessons to ensure you are safe and test ready. You should discuss, negotiate and arrange any required additional hours with the instructor.
  9. You cannot downgrade your course or reduce your course hours under any circumstances.
  10. We pledge to match you with an instructor within 10 working days of your provisional start date. If an instructor makes contact with you, and an agreement is reached, to start the course outside of the 10 working days or any following weeks, the deposit will become non-refundable as the course is successfully booked.
  11. If we are not successful in appointing you an instructor within the 10 working days, we will try to allocate an instructor to you the following week. Alternatively, you can request a deposit refund.
  12. If your deposit is refundable and you have already taken a theory test, the £35 fee for the theory test will remain non-refundable.
  13. Learners can book a course at any point in the future however you would only be matched with an instructor 4 weeks prior to your provisional start date.
  14. Once a course has started or a start date has been agreed by the instructor and learner, courses should be completed within the 4 weeks or total remaining hours, test fees and all cost related to the course is forfeited and non- refunded. Unless, an alternative agreement is reached by the learner and instructor.
  15. Please refrain from making any travel or accommodation arrangements. Additionally, do not book time off work until the course start date has been confirmed and agreed upon with the appointed instructor.
  16. All course start dates are provisional until course start date is confirmed and agreed with appointed instructor. Should an instructor be unavailable for your preferred start date, we will try to appoint you a different instructor the following week.
  17. Courses booked in your name cannot be transferred or sold to a third party.
  18. All special offers and course/lesson prices are subject to change without notice and are at the discretion of the company. If a gift voucher is supplied by DriveEpic, then the voucher is valid for a maximum period of 6 months from the date of issue. Gift vouchers are to be used by the person, or persons named on the voucher and are non-transferable.

Payments

  1. A deposit is not the full balance payable, it’s the initial payment that enables us to carry out the required administrative work (e.g. booking tests, locating and matching you with an instructor).
  2. Administrative work starts straightaway after a course is booked and the deposit is received, therefore up to 100% of the deposit is non-refundable.
  3. Final balance less deposit is payable ONLY to the instructor that will be instructing you. The instructor may request the payment 24 hours in advance to ensure that learner shows up for the lesson. Alternatively, you may transfer the remaining balance to us, and we can settle the remaining balance with the instructor on your behalf as an intermediary, if necessary.
  4. It is a non-negotiable requirement for the learner to settle the final balance in full with the instructor on the first lesson or 24 hours in advance. Failure to settle balance will result in the immediate cancellation of the course, the loss of deposit and test fees.
  5. Payments can be made online or over the phone using all major debit and credit cards.
  6. Any refund given will be made back to the card from which the original payment was made.

Test

  1. In the case the theory test should expire before a practical driving is sat, due to the failure to secure a practical driving test before the expiry date, we will offer to pay for a free theory test resit. However, it should be noted that the deposit it non-refundable, but a theory retest will enable you to both continue and complete the course.
  2. Excluding 5 and 10 hours manual and automatic courses. The course price list includes the practical test fees required for the chosen course – which includes the booking and arrangement of the test(s). Additional standalone costs and non-refundable test bookings that you may or may not require are;
    1. Theory test – £45

    2. Weekday practical test – £162

    3. Weekend practical test – £175

    4. Extended practical test – £204

  3. These tests can be booked independently for less, as well as searching for earlier driving test dates on the official DVSA booking website. However, it should be noted that, the standard wait time for a practical test can be from 4 to 12 weeks. The extra fees being paid ensures you will be provided with an automated process, which vets and checks for any driving test cancellations and short notice tests, that can be booked easily through our services, notifying you with an email and/or text, providing an easier, more stress-free process for you, the learner.
  4.  In the circumstance you have booked your own test, we will log in to the DVSA website using your details as provided by you, in order for us to manage the test booking. We may alter the contact email address so that we can receive notifications from the DVSA to ensure easier communication. While we make every effort to try to secure a practical test to correspond with your intensive course, at the closest and/or preferred test centre; the practical test availability is subject to the dates made accessible by the DVSA. On occasions where an appropriate test is not available, we will inform both you, and your instructor.  In such case we would recommend that you save at minimum a few hours in the following week/s to ensure you are prepared to take the test once it is confirmed.
  5. If we secure a weekend practical driving test with your approval. There will be an additional charge of £13.
  6. Should the situation arise where rescheduling or cancelling the test is needed, the adjustment or cancellation must be done at least five clear working days before the test date, to avoid losing the fee.
  7. A practical driving test cannot be booked until you have successfully passed the theory test and the theory pass number has been confirmed.
  8. It is your sole responsibility to ensure that you bring your provisional licence to the driving test.
  9. In the circumstance you choose to use your own car for the test, you will not be accompanied by the driving instructor and you will lose the reserved hours for the test day.
  10. DriveEpic and the ADI cannot be held liable and are not responsible for any tests which are cancelled by the DVSA for any reason OR the cancellation of intensive courses, due (but not limited) to;  force majeure, terrible climate i.e. snow or ice, examiner sickness, examiner strike, instructor sickness, vehicle breakdown and recall on vehicles. However, where possible your Instructor will rearrange any cancelled course.
  11. We will seek assurance from ADI’s that all cars used for test and course purposes are road worthy. However, we cannot be held liable for any faults that occur with the vehicle during your test or any loss arising from that. In this case the learner has to seek compensation solely from the instructor.
  12. In the event of the ADI’s vehicle breaking down during the course. The ADI should try to resolve the issue by repairing the vehicle to an acceptable standard or seek an alternative vehicle. Where no solution is found by you and your instructor, the instructor should issue you a refund of the outstanding hours and test fees.

Driving Instructor 

  1. All Instructors appointed are self-employed and independent Approved Driving Instructors who are fully vetted and registered by government agencies.
  2. All Instructors have their own policies regarding cancellations or rearrangements of lessons. It is your responsibility to comply with the instructor’s policies.
  3. Once the learner is matched with an instructor, the agreement of an intensive course and all driving lessons associated with the course are solely between the learner and the instructor to decide upon.
  4. Once a course start date has been agreed or lessons have begun between the learner and the instructor, the instructor cannot be changed. 
  5. We do not offer a service matching an instructor and a learner based on the individual personal preferences of the instructors, e.g. gender, race, age, vehicle type, vehicle age, vehicle colour, and vehicle fuel type.
  6. If the instructor feels that you are not ready for the practical driving test for reasons relating to; your, the examiner’s or other road user’s safety, the instructor has the right to refuse accompanying the learner to the test centre. Nor will the instructor be required to allow the use of his/her vehicle for the purpose of taking a practical test. If this is the case, you will lose your test fee and will not be offered a refund of any unused hours or any deposit or test fees.
  7. Your instructor has the right to cancel your driving lesson and course if your instructor is aware or reasonably suspects that you are under the influence of drugs/alcohol, are otherwise impaired, or reasonably believes your driving skills to be dangerous and/or illegal; putting you, your instructor or the greater public at risk.
  8. Your instructor has the right to cancel your driving lessons or course if you use abusive/ derogatory language, threatening behaviour, or if you fail to act on any reasonable request made by the instructor.
  9. Once you are matched with an instructor the agreement of an intensive course and all driving lessons associated with that course is solely between you and the instructor. Therefore, any disputes or claims should be taken up with your instructor firstly and not with DriveEpic.
  10. We cannot be held liable for any compensation claim from a learner or instructor, nor can we be held responsible or held liable for any penalty charges, notices for road traffic contraventions (on the part of the learner or instructor) including but not limited to, penalties and/or fines received for:
    1. Stopping in a junction box
    2. Driving above the speed limit
    3. Failing to stop at a red traffic light
    4. Failing to comply with road signs
    5. Parking fine

Use of Personal Data

  1. Any personal data provided to DriveEpic by you will be held and processed in accordance with the General Data Protection Regulation 2018 and will be used as follows:
    1. To match and appoint the learner with a driving Instructor to contact them regarding lessons, to book and reschedule practical or theory test or tests;
    2. To process and accept your payment for a course and/or test;
    3. To contact you if and when necessary concerning your course or test.
  2. Your data or information will only be shared with third parties where the law either requires or allows DriveEpic to do so.

 

 Limitation of Liability 

  1. Your instructor and DriveEpic are not liable for any loss or damage caused where, and to the extent that:
    1. There is no breach of a legal duty owed to you by your instructor and DriveEpic;
    2. Loss or damage is not a reasonably foreseeable result of such a breach;
    3. Any such loss or damage, or increase in loss or damage, results from any breach or omission by you;
    4. Any such loss or damage results from circumstances or matters outside of the reasonable control of your Instructor and DriveEpic.
  2. Your instructor and DriveEpic shall not be liable for losses relating to any business interests you may have including and without limitations of; lost profits, lost earnings, loss of opportunity of business or business interruption.
  3. You agree to inform your instructor and DriveEpic of any issues you experience regarding the intensive driving course in a timely manner. Any issues that occur prior to the final day of your intensive driving course which are then brought to DriveEpic’s attention after the course is complete will not be considered by DriveEpic.
  4. You are reminded that DriveEpic is not party to the contract for driving tuition or lessons itself, rather, this is between the learner and the instructor.
